This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "you," or "your") and PROWERK s.r.o., a company registered under the laws of the Slovak Republic, with its registered office at Nezabudkova 5, 821 01 Bratislava, Slovakia, Company ID (ICO): 56 206 640 ("Quizzolingo," "we," "us," or "our").
This Agreement governs your use of the Quizzolingo platform, including the web application, APIs, and related services (collectively, the "Software"). By accessing or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the Software.
The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all intellectual property rights (copyrights, trademarks, trade secrets, patents, algorithms, designs, and know-how), remain the exclusive property of PROWERK s.r.o. This Agreement does not grant you any ownership rights in the Software.
Subject to the terms of this Agreement, PROWERK s.r.o. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software solely for your internal business, educational, or personal purposes in accordance with your subscription plan or account type.
This license is conditional upon your compliance with this Agreement, the Terms of Service, and all applicable laws.

The source code of the Software is proprietary and confidential. This Agreement does not grant you any right to receive, access, copy, or reproduce the source code. The Software is provided as a service (SaaS) and in compiled form only. Any attempt to access, copy, or reproduce the source code is strictly prohibited and may result in immediate termination of this license and legal action.
You may not use Quizzolingo's trademarks, service marks, or logos without prior written consent.
You retain ownership of any content you create or upload to the Software ("User Content"). By using the Software, you grant PROWERK s.r.o. a limited license to store, process, and display your User Content solely for the purpose of providing the Software's functionality.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROWERK S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SOFTWARE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
PROWERK s.r.o. may terminate this license immediately if you breach any term of this Agreement. Upon termination, you must cease all use of the Software. Sections 2, 4, 5, 7, 8, and 10 shall survive termination of this Agreement.
You may terminate this Agreement at any time by ceasing to use the Software and closing your account.
This Agreement shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions. Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Bratislava, Slovak Republic.
We reserve the right to modify this Agreement at any time. If we make material changes, we will notify you by email or through the Software. Your continued use of the Software after such notice constitutes acceptance of the modified terms.
